killed a woman as she walked with her family over the weekend. 53-year-old ho sk sein tabrizi said he barreled on a sidewalk and plowed two women down. nbc bay area's jodi hernandez talks to the woman who injured his wife. she's still in the hospital. jodi, this is a horrible time for that family. >> reporter: jessica, it's tough to imagine what this family is going through. that family was walking down this sidewalk when tragedy struck. can you see teddy bears and flowers mark the spot where this crash happened. now, i had a chance today to talk to the young man who lost his mother here, and tonight is at the hospital bedside of his critically injured wife. >> it all happened so fast. >> reporter: that's how casey hahn describes the tragic crash that left his mother dead and his wife fighting for her life.

he says his 53-year-old mom sherry hicks and his step dad were visiting from santa barbara. they were walking home from starbucks wrapping up what he describes as a wonderful day. >> it should be a great day, first time i saw my mom in three months since i graduated coll e college. >> reporter: but just a block from home the unthinkable happened. police say 53-year-old hossein tabrizi drove his truck up on to the sidewalk striking hann's mother and his 23-year-old wife shane hahn. >> he was speeding. he came directly at us. there was no time to move, and i saw his eyes before he killed my mom. >> reporter: while it's unclear what led to the crash, nbc bay area has learned tabrizi has been in trouble before. he was convicted of dui in 2005 and of being drunk in public that same year. he was also convicted of petty

theft in 2007 and now he faces vehicular manslaughter charges. >> i hope there's some justice in this world, and i hope he can understand my suffering, hoping to understand just like he had with our family as a hole. >> reporter: casey hahn is now left to grieve for his mother and bray his newlywed wife pulls through. >> going to be better because she's strong and has never given up on anything in her life before. >> reporter: shane hahn remains in critical condition tonight and is in intensive care with a breathing tube but her family is sure she will pull through. the suspect is behind bars on one count of vehicular manslaughter and it's unclear when he'll be formally charged. reporting live in wall mutt week, i'm jodi hernandez, nbc "bay area news." >> jodi, thank you. a silent and moving tribute to the chp officer killed in the

line of duty. ladder trucks from contra costa fire were carrying the body of the fallen officer. the route was lined as the body left the medical examiner's office headed for a funeral home in knapp. the officer was removed from life support last week after he was shot during a traffic stop on 680 near alamo. >> some of the people that were on that zone and treated the officer are here today, and this is part of a healing process with him as well for him to come here and honor him like they are here with the trucks in san ramon. >> reporter: a memorial service is thursday morning at the mission church in vacaville. >> investigators say the 67-year-old was killed blocks

from the headquarters. the shooting marked the city's first homicide this year. >> christopher maffei faced the judge for the first time, the bay area father accused of kidnapping his two young children from their grandmother's home in south san francisco and sweeping them on to a stolen yacht. maffei is charged with eight felonies. he did not entry plea, but he did speak. maffei claims he was simply taking his home where they had been abused. the judge quickly cut him off for legal purposes. today's arraignment comes three days after the coast guard rescued the children from that yacht off the monterey coast. the children had been reunited with their mother. >> tomorrow, family, friend and neighbors from lafayette will come together to mourn the death of college student brett olson. fisherman found the 20-year-old's body near chico. not far from where he was last seen on labor day. a candlelight vigil will be held tuesday night at his alma mater. today counsellors were on hand

to meet with student and staff struggling to cope with that loss. >> it's awful. i mean, it's the worst thing that can happen to a parent and to a community so our community has really taken a -- an emotional toll because brett was so loved, and he's been such a -- he was so involved in our school. >> olson was a student at cal poly san luis obispo but in the chico area when he disappeared tubing down the river in an annual event. thousands of people helped search for him and a massive media effort kept his name in the news. a final plea for his political future. ross mirkarimi is asking for his official misconduct case to be postponed until after the november election. mirkarimi says having the board of supervisor decide his fate while up for re-election would deprive him of a fair hearing because of the political pressure. the ethics commission is

expected to consider the request tomorrow, but city attorney's office, which is representing mayor ed lee, opposes any sort of delay. mayor lee suspended the sheriff from office in march after he pleaded guilty to misdemeanor charges stemming from a fight with his wife that left her with a bruised arm. mirkarimi has apologized, and both he and lopez say the incident has been completely overblown. as of now, the san francisco board of supervisors is expected to decide within the next month whether mirkarimi should keep or lose his job. >> vallejos interim police chief is expected to address his community this hour. this comes after a series of officer-involved sheetings. officers have fired on suspects seven times since may and in five of those incidents the suspect died. the latest happened on september 4th when 23-year-old mario romeo was shot outside his wife. officers say he was reaching for something which ended up being a pellet gun.

it have could have been much worse but fire destroyed a detached garage near san jose state university. fire reported at the home on 11th street near st. john this morning. officials believe the fire started at an outlet which had a chainsaw plugged in. the owner was outside trimming some trees. the fire was out in 20 minutes, and there were no injuries. the garage though is a total loss, and there is minor damage to the kitchen. half of san jose's medical marijuana dispensaries are not paying taxes, and this week the city council will discuss whether that should be grounds to shut them down. the city's finance department claims 80 of the city's 158 dispensaries rarely, if ever, pay the voter-mandated marijuana tax. there's not much of a penalty for non-payment, and several council members want to change

that. on wednesday the council will discuss amending the municipal code to allow the city to revoke the licenses of tax-delinquent businesses, marijuanaor otherwise. sweeping changes in california's classrooms being proposed during a task force report from the state department of education. in a sacramento news conference, researchers propose sweeping changes in the way teachers are recruited, trained, evaluated and developed. co-chair of the task force, a professor at stanford. >> this is the first time in a generation that we've really taken stock what have it will take to produce a world class teaching force. we've just adopted world class standards for kids, the common course standards. we're ratcheting up our expectations for what children will learn. we have to raecht up our expectations as well for what teachers and school principals will be able to do. >> some of the proposals include new programs to help teachers early in their careers. another possibility requires teachers to get advanced schooling by tying it to renew

afl their teaching certificate. no more mystery meat. today was meatless monday for students in pleasanton. the school is taking part in a national movement to eliminate meat. today was day one. in the midst of a slowing national economy, consumer confidence in california is the highest it's been in five years. the survey done by chapman university shows the consumer confidence jumped five points since the second quarter. the index now clocks in at 94.2, up from 89 during the second quarter. chapman said the index has been steadily climbing since it fell to 57.6 during the second quarter of 2008. officials say any number below 100 suggests there's more pessimism in california than optimists, but the trend, they say, is moving in the right direction. >> speaking of confidence, confidence is very low tonight in a wednesday server company that before today was known for

those racy ads of theirs, especially on super bowl sunday. nbc bay area business and tech reporter scott budman joins us with big trouble for godaddy. >> today was not a good day for godaddy or the 5,000 businesses relying on its webber is vice verse. the website hosting company for reasons still being investigated was offline today taking the mostly small businesses it serves down with it. many of those businesses unable to sell anything online. godaddy says it's looking into why the service went down in the first place. more pain for hewlett-packard, the palo alto tech giant says it will lay off 2,000 more people as it cuts back to save money. hp now says it plans to cut 29,000 workers which october of next year instead of the previously announced 27,000. and while business is tough for very big companies struggling to find profits in a shrinking pc market, startups are hot, especially startups here in the bay area where there's lots of funding, lots of

former alameda county supervisor will be allowed to see her son as long as her husband is present. an orange county judge made that decision in drug and endangerment charges that lockyer is facing after her arrest on august 29th. she pled not guilty to shows charges. police found her to be under methamphetamine in the presence of her 9-year-old son. her estranged husband bill lockyer agreed to let her visit their son but only in his company. lockyer is out on condition she remain in a drug treatment if a sglilt tonight in our investigative unit report, board members for the bay area's biggest water district were paid to the ten events that appear to have nothing to do with water. jenna. >> the directors of the santa clara water district don't get the salary but they were

switchover has now, as you mentioned, been moved over to next week, as you mentioned also it replaces the old system which really isn't working for some people. andrew kuntz would much rather be in front of his computer downloading his police report but instead he's in line at police headquarters. >> someone crashed into my vehicle while it was parked on the side of the road. >> reporter: san jose police are about to unveil a new system where victims are supposed to unveil new violent crimes. they will also be able to download that report. >> if it was online, it would be much easier to request. i think we're all in line for the report. >> reporter: when he parked several cars on the avenue two weeks ago, some victims were told to file a report online in the old system that. same system has been frustrating ron cardinale who can't get his report to go through after a smash-and-grab burglar took his

wife's purse from the car. >> took him 15 minutes to go there and we just get error messages. >> reporter: police say they tested the system repeatedly and it's working just fine. beginning next week they will move into the new system by a sam ramon system called cop log logic. >> the engine was on fire in my car. >> reporter: that type of crime is not reportable on the old or new system because there was violence involved. the new technology should make it easier for victims of vandalism and threat to get their paper work filed and to give people like andrew kuntz back his lunch here. even with the old system or upcoming new system you can only report some non-violent crimes online. for instance, if you're the victim of a home burglary, a police officer has the response to your home.

damien trujillo, nbc "bay area news." >> busted for booze for teens. police arrested him after an underage drinking thing on friday. police say roger bloom bought alcohol for a teen acting as a decoy who was offering beer outside a liquor store. bloom is a 22-year fire fighting veteran and was one of seven people allegedly caught in that operation. >> today community groups were told about mistakes that were made by air quality officials and notifying the public about the dangerous pollution. all five agencies investigating last month's fire in richmond gave updates at the meeting. a spokesperson for the air quality management district initially reported all air samples were below state exposure levels. turns out one was above and within the normal range of what they see in the bay area. system is set up for everyday

testing. >> it's not set up, the emergency incident like the chevron fire. >> we are looking at monitoring cape abilities, in the only around chevron but other refineries making sure we've got consistent level of monitoring. >> reporter: looking at new technologies activists say more realtime information would help residents react quicker in the case of emergency. ininvestors will address the city council tomorrow. two men are safe tonight after the single-engine stalled and they were forced to crash land the plane on the water. this is footage of the rescue caught by the u.s. coast guard crew that made the daring saves. the crew was running out of fuel and had just three minutes to save the man in his 70s and his adult son and that wasn't the only risk that they were taking.

>> the aircraft rolled over to the left and saying shortly there after. >> had you been any later. >> had we been any later it's very possible that those two would have died last night. >> the two men were also saved by the high-stress beacon on board that send a strong beacon to the satellite t.provided a location of the vessel and also who owned it and the latest phone number to contact. >> border patrol arrests are at an all-time low. it's been difficult to fill planes and justify the cost to fill illegal mexican immigrants back home after they were caught entering the united states. the decision to halt those flights ends a seven-year experiment that cost taxpayers nearly 100 million. government officials say a more cost effective version of those flights may resume but not this year. chicago teachers walked off the job this morning leaving the parents of 400,000 kids

scrambling. teachers aren't striking over pavement they earn an average of $76,000 a year. they are unhappy with mayor rahm emanuel's push to cut health benefits and link evaluations to school performance. come schools were open so kids could have access to breakfast and lunch. the last strike in chicago was 25 years ago, and that one lasted 19 days. a blow to al qaeda tonight. one of its top commanders were killed in yemen. >> nbc "bay area news" commander is here. >> reporter: senior officials are confirming al qaeda's number two in command was killed by drone missiles. he and five others were killed as they were leaving the house in the southern part of yemen. al qaeda's yemen branch is considered one of the biggest threats to america. the u.s. believe he was directly involved in the failed underwear bomb attack on a u.s. airliner back in 2009. a changing of the guard as

today the u.s. officially handed over baghram prison to afghan officials. it was the largest u.s.-run detention facility in afghanistan located at baghram air base. it currently holds about 3,000 taliban and other terror suspects. meantime, the taliban in afghanistan issued a powerful threat today against britain's prince harry. do everything in their power to kidnap or assassinate him. the 27-year-old arrived in afghanistan last friday to serve a fewer-month tour of duty flying attack apache helicopters. prince harry is based out of camp bastion in the volatile helmand province. he served in afghanistan back in 2008, but that tour was cut short because of safety concerns. in iraq, another violent day. a car bomb exploded in the northern city of kirkuk. the target a city council member. he was hurt hey long with six of his bodyguards. today's attack comes after one of the bloodiest days in iraq since u.s. forces left the country last year. a series of bombs exploded

across baghdad killing more than 100 people in mainly shiite neighborhoods. al qaeda is claiming responsibility. in guantanamo bay, cuba, u.s. officials are trying to determine the cause of a death of a prisoner. he's the ninth inmate who has died there since the facility opened up back in 2002. guards found him unconscious in his cell over the weekend. they took him to the hospital where he was pronounced dead. his name and nationality have not been released yet. as for the eight other deaths, two were from natural causes and six were deglad suicides. the u.s. still holds nearly 170 prisoners at that military base. and those are your international headlines. >> thank you. on the eve of the 9/11 an verse rite federal government is adding 58 kinds of cancer to the list of illnesses linked to that disaster. this will bring more aid to rescue workers and people living near ground zero on september 11th, 2001. also today, secretary of defense leon panetta visited the 9/11 shanksville, pennsylvania

in health matters tonight, surprising new findings about the eating habits of obese children. a study from the university of north carolina says that overweight teens actually consume less calories on average before their peers but still weigh more. that's because they are more active and burn fewer calories each day. intervention programs should focus on keeping -- >> parents who send their kids to private schools will less likely to immunize their kids than public school kids, especially in marin county. associated press analysis found

colder fall and also winter on the books. under an el nino watch at this point. 51? santa rosa and double 55s in the almondin valley. real close to what we had today in the south bay and 84 in morgan hill and 80 in palo alto and then for the tri-valley, it will be pretty warm here. not quite hot. we're not expecting widespread 90s. 84 in walnut creek and back into livermore, 87 for you and 58 in pleasa pleasanton. san francisco, not quite 70s, slight cooler wind with 67 for you. 84 in santa rosa and 60s for the coastline. back here from berkeley to observing land, low 70s. on your three-day forecast, we do get widespread 90s inland on that forecast as we head
